Private Health Insurance Legislation Amendment Bill (No.1) 2010 – Conditional Listing of Prostheses and new Part C of the Prostheses List.

Previously cited as Private Health Insurance Legislation Amendment Bill (No.2) 2009.

The Private Health Insurance Legislation Amendment Bill (No.1) 2010 (the Bill) was passed by the Senate on 18 March 2010 and came into effect on 13 April 2010.

The Bill amends the Private Health Insurance Act 2007 to allow the Prostheses Rules:
  • to include additional circumstances or conditions that must be satisfied before a private health insurance benefit is payable for some prostheses (conditional listing); and
  • to include additional criteria in relation to the listing of prostheses on the Prostheses List. Additional criteria will be developed for the new Part C to the Prostheses List proposed by the Government. Criteria for Part C are currently being developed by the Government, taking into account advice from the Prostheses and Devices Committee (PDC).
    The Private Health Insurance (Prostheses) Rules will be amended in due course.
